Terms of Service

By downloading or using AVGusto, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.

AVGusto is an AI-powered food scanning and nutrition tracking application. Using your device camera and OpenAI’s Vision API, the app identifies foods in photos and provides estimated nutritional information including calories, protein, carbohydrates, and fats. The app also provides a daily food diary, macro tracking, and optional cloud sync for Pro subscribers. AVGusto can optionally connect to Apple Health (iOS) or Health Connect (Android) to adjust your calorie budget based on your physical activity and to write your nutrition summaries back to those services.

You must be at least 13 years of age to use AVGusto. By using the app, you represent and warrant that you are 13 or older. If you are under 18, you must have parental or guardian consent to use the app.

You must create an account via Firebase Authentication (email/password or Google Sign-In) to use AVGusto. By creating an account, you agree to:

• Provide accurate and complete registration information
• Keep your account credentials secure and confidential
• Notify us promptly if you suspect unauthorized access to your account
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

AVGusto offers a free tier with limited AI scans, one-time scan pack purchases, and a Pro subscription with full access to all features.

Pro Subscription Plans

• Monthly Plan: Auto-renewing monthly subscription
• Annual Plan: Auto-renewing yearly subscription

One-Time Purchases

• Scan Packs: You may purchase a pack of additional scans as a one-time (consumable) purchase. Scan packs do not expire but are consumed as you use them.
• Scan packs are consumable products — they cannot be restored via “Restore Purchases” after use.

Billing and Cancellation

• Subscriptions are processed by Apple App Store or Google Play Store via in-app purchase. Subscription management is powered by RevenueCat.
• Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period.
• To cancel, manage your subscription in your device’s App Store or Play Store account settings. Cancellation through the app alone is not sufficient.
• We do not offer refunds except as required by applicable law. All purchases are final.
• Prices are subject to change. We will provide reasonable notice of any price changes.

A Pro subscription unlocks the following features:

• Unlimited AI meal scans
• Detailed micro-nutrition (fiber, sugar, sodium, ingredients)
• History and trends — weekly and monthly nutrition reports
• Activity insights — weekly and monthly activity breakdown and activity/weight correlation
• Cloud sync and backup across devices
• No ads

Free tier users receive 3 AI scans per day, resetting at midnight. When daily scans are exhausted, you may watch a rewarded video ad for one bonus scan, purchase a scan pack, or upgrade to Pro. Features may change over time; we will communicate material changes through the app.

Fair Use for Future AI Features

Pro and Pro+ subscriptions provide unlimited access to AI-powered food scanning under fair use. We reserve the right to introduce per-feature monthly allowances for new AI features (such as fridge inventory scanning, recipe generation, and hands-free voice cooking) introduced after the date of subscription. Existing features available at the time of your subscription remain unmetered for the duration of your subscription term.

Estimates Only

All nutritional information provided by AVGusto is generated by artificial intelligence and represents estimates only. AI food recognition is inherently approximate. Calorie counts, macronutrient values, and portion estimates may not be accurate.

Not Medical Advice

AVGusto is NOT a medical device and does NOT provide medical advice, dietary advice, or clinical nutrition guidance. The information provided by this app is for general informational and personal tracking purposes only.

• Do not use AVGusto as a substitute for advice from a qualified healthcare provider, registered dietitian, or physician.
• If you have a medical condition, eating disorder, food allergy, or specific dietary needs, consult a licensed professional before making dietary changes based on this app’s output.
• We make no guarantee regarding the accuracy, completeness, or fitness for any particular purpose of the nutritional data provided.

By using AVGusto, you agree to:

• Use the app only for lawful personal purposes
• Not attempt to reverse engineer, decompile, or tamper with the app or its underlying systems
• Not attempt to extract API keys, AI models, or proprietary components from the app
• Not use the app in any way that could damage, disable, or impair our services
• Take sole responsibility for any dietary or health decisions you make based on information from this app

Free tier users may be offered the option to watch rewarded video ads (powered by Google AdMob) to earn bonus scans. Rewarded ads are always opt-in — they are never shown without your explicit consent. Pro subscribers are not shown any ads.

Your use of AVGusto is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the app, you consent to the data practices described in the Privacy Policy, including the transmission of meal photos to OpenAI’s Vision API for analysis, the storage of your profile data in Firebase Firestore, the storage of your profile avatar in Firebase Storage, and — if you choose to connect Apple Health or Health Connect — the on-device reading of your activity and weight data and the writing of your nutrition data back to those services.

You may request deletion of your account and associated data at any time by contacting us at the email address below. Upon account deletion:

• Your Firestore profile data will be removed
• Any uploaded avatar photo stored in Firebase Storage will be deleted
• Meal data stored locally on your device must be cleared by uninstalling the app or using the in-app delete functionality

Subscription cancellation does not automatically delete your account data.

AVGusto and all content, branding, logos, and software are owned by us or our licensors. These Terms do not grant you ownership of any intellectual property. You may not copy, modify, distribute, or create derivative works from the app without our explicit written permission.

To the maximum extent permitted by applicable law, AVGusto and its creators, officers, employees, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to:

• Inaccurate nutritional estimates from AI food recognition
• Dietary or health decisions made based on app data
• Loss of data or interruption of service
• Any reliance on information provided by the app

Our total liability to you for any claims arising from these Terms or your use of the app shall not exceed the amount you paid for the app or subscription in the 12 months preceding the claim.

We may update these Terms of Service at any time. Your continued use of the app after changes constitutes your acceptance of the revised terms. We will make reasonable efforts to notify you of material changes through the app or by email. We recommend reviewing these Terms periodically.
